Single Sale Buyer Agreement & Certificate of Authenticity

This Agreement (“Agreement”) is made between the purchaser (“Buyer”) and the artist, Macaulay Woods (“Artist”). By purchasing an artwork from the Artist, the Buyer agrees to the following terms:

1. Ownership

  • The Buyer owns only the physical artwork purchased.

  • All copyright, intellectual property, and reproduction rights remain with the Artist.

  • The Buyer may not reproduce, publish, or create derivative works from the artwork without the Artist’s written permission.

2. Certificate of Authenticity (COA)

  • This Agreement serves as the legal acknowledgment of the transaction.

  • A custom COA / Purchase Order with specific artwork details will be provided to the Buyer at pickup or via email.

3. Delivery / Fulfillment

  • Complimentary shipping is available within the continental United States. All domestic shipments include insurance and tracking.

  • International shipping is available and quoted upon inquiry. International buyers are responsible for all customs duties, taxes, and import fees applicable in their country.

  • Local pickup and New England regional delivery are also available by arrangement.

  • Artwork will be professionally packaged to ensure safe delivery.

  • The Buyer must arrange pickup or delivery within 30 days of purchase. After 30 days, the Artist may return the artwork to inventory.

  • Failure to pick up or arrange delivery does not release the Buyer from payment obligations.

4. All Sales Final

  • All sales are final.

  • By completing a purchase, the Buyer acknowledges that they cannot cancel, return, or exchange the artwork after payment is processed.

  • Any requests for changes or cancellations must be made prior to payment completion and are subject to the Artist’s discretion.

5. Acknowledgment of Visual Variations and Acceptance

  • The Buyer acknowledges that digital images of the artwork provided on the Artist’s website, social media, or other marketing materials are for reference only.

  • Colors, texture, gloss, and other visual qualities may vary in person due to lighting, display, device settings, and medium characteristics.

  • The Buyer accepts the artwork as it appears upon delivery or pickup.

  • Refusal to accept the artwork or claims of visual discrepancies do not constitute a valid reason for cancellation or refund.

6. Use, Display, and Alteration

  • The Buyer may display or hang the artwork as desired.

  • The Buyer may not reproduce, digitally scan, modify, or create derivative works from the artwork without written permission from the Artist.

  • The Buyer may destroy the artwork if desired, but this does not transfer any intellectual property or reproduction rights.

7. Appropriation / Sampling

  • No part of the artwork may be used to create a new work or reproduced in any medium without the Artist’s prior written permission.

  • This includes sampling, cropping, or incorporating sections of the artwork in other creations.

8. Resale

  • The Buyer may resell the physical artwork.

  • The Buyer may not sell reproductions, prints, merchandise, or digital versions derived from the artwork.

  • The COA may accompany resale but may not be used to claim rights beyond ownership of the original artwork.

    • The Buyer may not mint, tokenize, digitize, or otherwise create NFTs or blockchain-based representations of the artwork.

9. Agreement Acknowledgment

  • By purchasing the artwork, the Buyer acknowledges that they have read and understood this Agreement and agree to be bound by its terms.

  • This Agreement is effective as of the date of purchase indicated on the accompanying Certificate of Authenticity.

Certificate of Authenticity:
This document certifies that the purchased artwork is an original work by Macaulay Woods. A personalized COA with full artwork details will be provided to the Buyer at pickup or via email.
